In this training course John Heaton and Mark Davies will bring their combined experience of 60 years representing operators who have been prosecuted for overloading and load security related offences and dealing with Public Inquiries that arise out of these issues.

Whilst prosecutions for overloading offences are much fewer in number than 10-15 years ago the Traffic Commissioners consider overloading a “most serious infringement” under which they are obliged to consider revocation of operators’ licences. Also, Commissioners are holding Public Inquiries where the single issue is a load loss. We will consider the various codes of practice and discuss the type of training operators are expected to have provided to their drivers, risk assessments that should be in place, monitoring and what to do in the event of an overload or loss of load.

This course will be from the angle of considering the approach of the DVSA and Traffic Commissioners, the Police and the HSE.
